WEEE - Approved producer compliance schemes (26/02/2007)

Following the initial approval of 5 Producer Compliance Schemes earlier this month, the Environment Agency has now produced an updated list of schemes at the 23 February together with a provisional list of schemes which may be subject to later approval.

From 1 July 2007, producers of Electrical and Electronic Equipment (EEE) will be responsible for paying for the treatment and recycling of products at the end of their life in accordance with the regulations.

Many producers will not have the facilities to do this themselves and so will join a producer compliance scheme. These schemes will help companies meet the requirements of the WEEE Regulations by collecting and recycling products on their behalf.  There is a deadline of 15 March 2007 to join approved compliance schemes.

Producers including manufacturers, rebranders and importers of electrical and electronic equipment (EEE).

The new list of schemes is considerably more extensive than that previously published as the original 5 approved schemes in early February now stand at 21 approved with, in addition, a further 3 schemes approved by SEPA (Scottish Environmental Protection Agency).

Of the schemes approved so far, only the City Compliance scheme is a “closed” scheme, i.e. it is not open to general membership and consists of one member only.  The scheme’s operator is WERCS Ltd of Huddersfield.

The remaining approved schemes are “open” schemes that are open to membership subject to meeting scheme criteria.

WEEE Regulations

The Waste Electrical and Electronic Equipment (WEEE) Directive was adopted by the European Union in 2003. The aim of the Directive is to reduce the amount of WEEE being disposed in landfills by encouraging separate collection, treatment and recycling and hence deal with these waste materials in a more sustainable manner.

The Waste Electrical and Electronic Equipment (WEEE) Regulations 2006, which implement most aspects of the WEEE Directive in the UK, came into force on 2 January 2007. 
These new regulations are implemented separately by devolved administrations in the UK with The Waste Electrical and Electronic Equipment (Waste Management Licensing) (England and Wales) Regulations 2006 coming into force on 5 January 2007. These Regulations deal with the site licensing and WEEE treatment requirements of the WEEE Directive.

The Environment Agency’s responsibilities for WEEE

The Environment Agency is the regulator for the majority of elements of both sets of WEEE regulations in England and Wales and is responsible for the following:

• approval of producer compliance schemes;
• managing data on market share, WEEE collection, treatment and reprocessing;
• registering producers of electrical and electronic equipment and maintaining a public register;
• identifying 'free-riders' and bring them into compliance;
• regulating sites that will store and treat WEEE;
• approving treatment facilities and exporters of WEEE so that they are able to issue evidence of treatment and recovery;
• monitoring and enforcing compliance with the treatment and recovery requirements.
