The owner of a Dundee car breakers business was fined £1,000 at Dundee Sheriff Court, for illegally operating a scrapyard.
Michael Phinn, trading as Lochee Car Disposal, admitted depositing household, commercial and industrial waste without a licence on a site in Perrie Street, Dundee.
SEPA officers were undertaking an investigation of the yard when the incident came to light in April, 2005. The officers involved noted vehicles, vehicle components and parts, tyres and metals on the site which was not licensed to accept them.
The un-licensed activities had continued despite SEPA officers informing Mr Phinn of the legal requirements.
The offence was reported to the Procurator Fiscal by SEPA.

SEPA Environmental Protection and Improvement officer Owen Foster said:
“At the time of the offence Mr Phinn was not licensed but was carrying out unauthorised waste activities at the yard despite SEPA officers informing him of the legislative requirements.
“SEPA is satisfied the matter has reached a conclusion. Mr Phinn is now in possession of a Waste Management Licence and SEPA will continue to assess compliance with the legislation at his premises.
“SEPA will continue to use its powers to take appropriate enforcement action against those who operate outwith the law.”

On 12 April 2005 in or on land at the Former Breakers Yard, Unit Six, Ardyle Works, Perrie Street, Dundee NGR NO 3732 3188 you Michael Phinn trading as Lochee Car Disposal did deposit or knowingly cause or knowingly permit, controlled waste, namely household, commercial and industrial waste, including vehicles, metals, tyres, vehicle components and parts to be deposited in or on said land without the authority of a waste management licence; contrary to the Environmental Protection Act 1990, section 33(1)(a) as amended.
