The following is a brief summary of some of the key UK legislation and regulations affecting England and Wales in particular on waste management. However the list is not comprehensive, nor exhaustive and there is much legislation applicable in Scotland and Northern Ireland that is not summarised.

Control of Pollution (Amendment) Act 1989

Enacted under The Control of Pollution Act 1974. Introduced the Registration of Waste Carriers making it an offence for any person who is not a registered carrier of controlled waste, in the course of any business of his or otherwise with a view to profit, to transport any controlled waste to or from any place in Great Britain, though with specific exceptions.

Clean Neighbourhoods and Environment Act 2005

This Act dealt with a wide range of environmental issues some of which were waste related including abandoned vehicles. The Act widened the offence of dropping litter by including all areas open to the air, though with specific exceptions. It dealt with modifications to the requirement for registration of waste carriers including defences available.

Interestingly the Act removed the requirement to contract out waste disposal functions as required originally under the EPA 1990. This earlier led to the formation of Arms Length companies (LAWDCS) or complete privatization in some cases.

The concept of raising site waste management plans was introduced for waste created in the course of specified descriptions of works involving construction or demolition.

Environment Act 1995

Established the Environment Agency and the Scottish Environmental Protection Agency (SEPA). S57 important in enabling the introduction of legislation specific to contaminated land. S92 required the Secretary of State to produce a strategy for the recovery and disposal of waste.
